PERSONAL

DATA PROCESSING
Chiocciola S.r.l. guarantees its customers compliance with the legislation on the processing of personal data, governed by the Privacy Code referred to in Legislative Decree no. 196 of 30.06.03.
User registration is not mandatory to make a purchase, it will be enough to provide only the information strictly necessary for the fulfillment of the order and the delivery of what was purchased.
The personal data requested when placing the order will be collected and processed on computer media by the site manager, for the sole purpose of satisfying the obligations deriving from the contract concluded with the Customer and will not be transferred to third parties under any circumstances and for any reason.
The Customer has, at any time, the right to revoke consent to the processing of personal data by written communication to be sent to the registered office of “La Chiocciola S.r.l.”.
Marketing communications will be sent only with the explicit consent of the Customer, issued together with the authorization to process the data.
The data controller is La Chiocciola S.r.l., via Circonvallazione n.16, 20814 Varedo (MB), in the person who has legal representation, unless a manager is appointed pursuant to art. 29 of Legislative Decree no. 196/2003.
The Customer, who declares to have received the information pursuant to art. 13 and on the rights due to the same, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access their data in the manner provided for therein.

PAYMENT METHODS Chiocciola S.r.l. offers

the possibility to choose between different payment methods:

PayPal
If you want to buy with PayPal
, once the order has been placed, the relative amount is debited from the Customer's PayPal account at the time of its acquisition.
It will be possible to cancel the order only if it is not yet being processed. In case of cancellation, both by the Customer and in the case of non-acceptance of La Chiocciola S.r.l., the amount will be refunded to the Customer's PayPal account.
Under no circumstances can La Chiocciola S.r.l. be held responsible for any direct or indirect damages caused by a delay in the non-release of the amount committed by PayPal.
For each transaction made with the PayPal account, the Customer will receive a confirmation email from PayPal.
At no time during the purchase process does La Chiocciola S.r.l. have the opportunity to know the Customer's financial information.
No computer archive of La Chiocciola S.r.l. contains or stores such data.

Credit Card
If you prefer to buy with a Credit Card, the authorized circuits are VISA, MasterCard and Maestro, through a secure server managed by Bankpass Web.
To make transactions more secure, La Chiocciola S.r.l. uses VBV (Verified by Visa) and Secure Code by MasterCard services.
Chiocciola S.r.l. reserves the right to request additional information from the Customer (e.g. landline telephone number) or to send copies of documents proving the ownership of the card used.
In the absence of the required documentation, La Chiocciola S.r.l. reserves the right not to accept the order.
At no time during the purchase process, La Chiocciola S.r.l. will be able to know the customer's credit card information, as these are entered directly on the website of the banking institution that manages the transaction and which has very high security systems.
Since there is no transmission of data, there is no possibility that this data will be intercepted.
No computer archive of La Chiocciola S.r.l. contains or stores such data.
Under no circumstances can La Chiocciola S.r.l. be held responsible for any fraudulent and undue use of credit cards by third parties, upon payment of products purchased on www.lachiocciolababy.it.

Bank Transfer
In case of payment by Advance Bank Transfer, the order will be sent only after the amount due has been credited to the account of La Chiocciola S.r.l. which must take place within 7 working days from the date of acceptance of the order. After this deadline, the order will be automatically canceled.
The reason for the bank transfer must state:
  • Name and surname of the order holder;
  • Order reference code (Purchase CODE);
  • Date of placing the order.
Chiocciola S.r.l. guarantees that what the Customer ordered will be reserved until proof of transfer has been received.
To speed up shipping times, La Chiocciola S.r.l. invites you to send a copy of the transfer no later than 3 working days from the date of acceptance of the order, with the CRO number, by e-mail to the address: ordini@lachiocciolababy.it.

Cash on Delivery
In case of purchase with Cash on Delivery, an additional contribution of €5.00 is applied to the total amount of the order (product (s) + shipping costs.
For cash on delivery, simply select the relevant payment method when placing the order.
For information, the Customer can contact the Staff of La Chiocciola S.r.l. at 345.2280233 or send an email to ordini@lachiocciolababy.it.
The payment can be made to the courier with cash. The Customer is required to prepare the exact amount, there is no possibility of the rest.
Payment can also be made upon arrival of the courier by cashier's check. However, bank checks are not accepted by the courier.
For cash on delivery payments of amounts greater than the limit established for the use of cash by the regulations currently in force, only Circular Checks are accepted.
The cash on delivery method is not allowed for orders with delivery outside Italian territory.

TRANSACTION SECURITY

If the Customer buys with a Credit Card
La Chiocciola S.r.l. to secure credit card payments (VISA, MasterCard and Maestro), it uses the Verified By Visa and Mastercard Secure Code service.

If the Customer buys with PayPal
PayPal is the best known and most reliable system for carrying out online transactions. Security derives from the fact that, at the time of payment, there is direct communication between the customer's internet browser and the PayPal channel, a secure and encrypted channel. Thanks to this, no one can intercept the data relating to the Customer's card.
Chiocciola S.r.l. therefore, at no time during the purchase process has the opportunity to know the Customer's financial information.
Since there is no transmission of data, there is no possibility that they will be intercepted.

DELIVERY METHODS AND TIMES

The goods can be shipped to your home by express courier, or collected at the point of sale.
La Chiocciola S.r.l. guarantees safe delivery methods and short times.
For orders with delivery outside Italian territory, the cash on delivery method is not allowed.
Deliveries are entrusted to technical partners of the highest quality and reliability, leading in Italy for the management of express deliveries, such as GLS, Bartolini S.p.A. Shipping methods:



  • Standard Shipping: guaranteed delivery throughout Italy in 4/5 working days from the moment the payment is displayed on the bank account. Cost 9.90€, free for orders over 29.90€
  • European Union Shipping: Portugal, Spain, Luxembourg, Belgium, Holland, Germany, Austria, Denmark, Poland, Slovak Republic, Hungary, Croatia, Romania, Bulgaria, Greece, Lithuania, Estonia, Latvia, Sweden, Finland, Ireland, France, Czech Republic, Slovenia: 7/10 working days 50.00€, with the exception of wooden items which cannot be shipped. Payment on delivery is not allowed.
For delivery times, weekends and holidays should not be considered.
There may be delays or changes in delivery times due to force majeure, not dependent on the will of La Chiocciola S.r.l. (traffic, strikes, bad weather, etc.), but dependent on impediments found by the courier and should not be considered demanding for La Chiocciola S.r.l
. Deliveries take place at the following times: from 8.00 to 19.00, every day, not holidays, from Monday to Friday.

If the Customer is not at home when the courier arrives, the courier leaves a notice and will return the next business day.
After that we will receive the notification of the opening of the order stock, the Customer will be contacted to decide how to unlock the package stock.
If within 5 days from the notification of the opening of the stock there are no answers from the Customer, the goods will be returned to the sender.
The new shipment will be borne by the customer.

What to check when the courier arrives: Upon arrival of the courier, the recipient must verify that the packages are perfectly sealed, that the number of packages corresponds to that marked on the accompanying document.

Any damage or the mismatch of the number of packages or indications must be immediately reported to the courier who makes the delivery by writing WITH THE RIGHT TO RESERVE

ASSISTANCE FOR DELIVERIES.

In case of
doubts or problems, La Chiocciola S.r.l. is always available to the Customer.

For each order placed on www.lachiocciolababy.it, La Chiocciola S.r.l. issues and sends a Tax Receipt for the purchased material, to be kept for the Warranty on the Product (s). If the Customer wishes the Invoice, he must enter the VAT number and Tax Code in the appropriate fields.
The information provided by the Customer at the time of the order will be authentic.
Any changes in the invoice will be possible after the first delivery attempt.

If you choose to pick up at the point of sale, the Staff of La Chiocciola S.r.l. will be happy to meet the customer and get to know his family!
Thanks to this solution, you can shop online on www.lachiocciolababy.it and pick up the products ordered at the La Chiocciola S.r.l. store, in via Circonvallazione, 16 20814 Varedo (MB), during store opening hours.
By taking advantage of this opportunity, the Customer will save shipping costs.
How to proceed with the purchase with in-store pickup?

Wait for the confirmation e-mail from La Chiocciola S.r.l. informing you that the product (s) are ready for collection at the store.
Contact the store directly 24/36 hours in advance at 0362.554368, to arrange the day of collection.
The collection takes place at the store located in Varedo 20814 (MB), Via Circonvallazione, 16.

IMPORTANT: In order
to guarantee maximum security to Customers, the goods may be collected upon presentation of the order confirmation sent via e-mail and the presentation of the identity document or proxy with a photocopy of the valid document attached.

PRODUCT AVAILABILITY Most of

the products
on www.lachiocciolababy.it are ready for delivery, while the other products can be ordered because they are being restocked and require a maximum waiting time of 25 working days.
Any or additional delays due to production or logistics problems of the manufacturing companies will be promptly notified by the staff of La Chiocciola S.r.l.
In the event that the order concerns both available products and products that can be ordered, the goods will be shipped in a single solution upon arrival of the ordered products.
If the Customer wishes to receive the goods in two different solutions, the shipping costs borne by the Customer are due for each individual shipment. In this case, after the order, the Customer will be contacted by the Staff of La Chiocciola S.r.l. to establish the payment methods for the shipments concerning the ordered item.
If the goods are available in stock, as highlighted on the website www.lachicciolababy.it, the order is processed within 24/36 hours. In any case, the goods will be delivered to the courier after the payment has been displayed in the current account.

PRODUCT WARRANTY

Pursuant to Legislative Decree 24/02, all products on sale are covered by the manufacturer's conventional warranty and the 24-month warranty for lack of conformity.
In order to take advantage of this service, the Customer is invited to keep the invoice/copy of the receipt that he will receive upon delivery of the Product (s). By accepting the purchase contract,
the Customer acknowledges the Assistance modalities in force in the case of recourse to Warranty Assistance.
The 24-month warranty pursuant to Legislative Decree 24/02 applies to the product that has a lack of conformity, provided that the product itself is used correctly, in compliance with its
intended use and the provisions of the attached technical documentation. This guarantee is reserved for private consumers.
In the event of a lack of conformity, La Chiocciola S.r.l. restores the product's conformity by repair/replacement, until the contract is terminated.
Only after the authorization has been issued, the Customer must send the goods to the La Chiocciola S.r.l. store.
In the event that, for any reason, it is unable to return a product under warranty (restored or replaced) to its Customer, La Chiocciola S.r.l. may proceed at its discretion to return the entire amount paid or to replace it with a product with equal or superior characteristics.
If, following intervention by an Authorized Service Center, the defect is not covered by the manufacturer's conventional warranty, the Customer will be charged for any verification and restoration costs required by authorized assistance, as well as transport costs, if incurred by La Chiocciola S.r.l.
The replacement or possible repair of the product is subject to the manufacturer's own timing and the companies' service centers and cannot be attributed to La Chiocciola S.r.l..
In the event that the warranty provides for the return of the product, it must be returned by the Customer strictly in the complete original packaging (including packaging, any documentation and accessory equipment: manuals, cables, etc...).
To limit damage to the original packaging, we recommend, whenever possible, to insert it in a second box. In all cases, the affixing of labels or adhesive tapes directly to the original packaging of the product should be avoided.
All shipments of products that do not include original packaging, accessories and manuals or received with
unsuitable or inadequate external packaging will be rejected to the Customer, at his expense.
Therefore, the damage suffered by the products during transport due to the lack of adequate external protective safety packaging not authorized by the service center, will not be covered by the Warranty.
If the product is tampered with or the labels identifying the Serial Number are removed or tampered with, La Chiocciola S.r.l. reserves the right not to accept the validity of the Warranty.
In the event of changes to the Warranty Conditions, La Chiocciola S.r.l. will apply the conditions contained in the Warranty for products in force at the time of the Customer's purchase.

RIGHT OF WITHDRAWAL

The Consumer Customer, as defined by art. 3 of the Consumer Code, has the right to withdraw from the Purchase Contract by means of a written communication to be sent by registered letter with return receipt, before the expiry of the Withdrawal Period as indicated below, addressed to:

Alternatively, the Customer may send the Notice of Withdrawal, within the Withdrawal Period indicated below, by e-mail to ordini@lachiocciolababy.it.
The Notice of Withdrawal must contain the will to withdraw from the Purchase Contract and specify the Product (s) for which you intend to exercise the Right of Withdrawal.
The Customer has the rights set out in articles 52 et seq. of the Consumer Code, as amended by Legislative Decree no. 21 of 21/02/2014, so he has the right to withdraw from the Purchase Agreement (right of Withdrawal) for any reason, without obligation to specify it and without any penalty, within 14 (fourteen) days from the day on which the Consumer or a third party designated by the consumer and other than the Carrier, receives the product (s). The return of the product (s) must be made by the Customer strictly in

complete original packaging (including packaging, any documentation and accessory equipment: manuals, cables, etc...). To limit damage to the original packaging, it is recommended, whenever possible, to insert it in a second box. In all cases, the affixing of labels or adhesive tapes directly to the original packaging of the product should be avoided.

The Return of the Product (s) must take place within 14 days from the date of sending the communication with which the Consumer expressed his decision to withdraw pursuant to art. 52 of the Consumer Code, to the address of the La Chiocciola S.r.l. store, Via Circonvallazione, 16 20814 Varedo (MB).
The deadline will be respected if the Consumer returns or returns the Product (s) subject to Withdrawal before the 14-day deadline.
The Consumer may return the Product (s) by going to the store located in Varedo (MB), Via Circonvallazione, 16.


The transport costs related to the return of the Product (s) subject to Withdrawal are borne by the Consumer and the Return is under the full responsibility of the Consumer himself.
If the right of Withdrawal has been properly exercised in accordance with the provisions of articles 52 and following, Chiocciola S.r.l. will return to the Consumer, within 30/45 days from the date of receipt of the products by the Customer, the entire price paid by the Customer in case of returning the product complete with all its parts and functionality, excluding bank and shipping costs.
The amount will be reimbursed using the same payment method used by the Consumer for the initial transaction, unless the Consumer specifically requests otherwise and provided that the Consumer does not have to bear any costs as a consequence of the reimbursement.

CONDITIONS
These general conditions of sale are governed by the Consumer Code (Legislative Decree no. 206 of September 6, 2005) and by the regulations on electronic commerce (Legislative Decree no. 70 of April 9, 2003, Law on Electronic Commerce) and apply exclusively to the remote sale via the Web of the Products identified on the website www.lachiocciolababy.it.
Pursuant to art. 50 et seq. of Legislative Decree 206/2005 and Legislative Decree 70/3003, the offer and sale on the website www.lachiocciolababy.it are part of a distance contract, concerning the sale of Products on the website www.lachiocciolababy.it., between Chiocciola S.r.l., with registered office in Varedo (MB), Via Circonvallazione, 16, VAT number 02999690965 and the Consumer.
These general conditions of sale (“General Conditions”) and, in particular, the information referred to in art. 52 of the Consumer Code, as provided by la Chiocciola S.r.l., will remain valid and effective until they are modified and/or supplemented by La Chiocciola S.r.l. Any changes and/or additions to the General Conditions will be effective as of the date on which they will be communicated to the public and will apply to sales made starting from that date.
The latest updated version of the General Conditions is the one on the Site.

prices
The sales prices of the products shown on the Site are inclusive of VAT and any other tax.

Purchase and payment methods
La Chiocciola S.r.l. offers its customers the possibility to choose between different payment methods: payment on delivery (Cash on Delivery), Credit Card, Advance Bank Transfer or PayPal, as specified more fully in the “Payment Methods” section.

Delivery of products
La Chiocciola S.r.l. delivers the products to the address indicated by the Customer within the time frame selected when the products were purchased.
Any complaint can be forwarded to the address: La Chiocciola S.r.l., Via Circonvallazione, 16 20814 Varedo (MB).

Availability of products
La Chiocciola S.r.l. accepts customer orders within the limits of the quantities of the requested products existing in stock or that can be ordered from the manufacturing companies.
Chiocciola S.r.l. undertakes to promptly notify the Customer of any unpredictable stock runs out due to excess demand or other causes.

Customer Obligations
The Customer declares and guarantees the following:

  • To be a consumer in accordance with art. 3 of the Consumer Code;
  • To be of legal age;
  • That the data provided by the same for the execution of the Contract are correct and truthful.

Right of Withdrawal
The Consumer Customer, as defined by art. 3 of the Consumer Code, has the right to withdraw from the Purchase Agreement.
